Former Public Protector Adv Mkhwebane has won first round of a war which seems to be personal between her and her successor Adv Kholeka Gcaleka on refusing to give her, her R 10million gratuity after leaving office.
Ruling on the matter at the Pretoria High Court on Thursday, Judge Colleen Collis found that the public protector may have committed perjury by making inaccurate allegations under oath.
War between the two on the matter started when Mkhwebane was impeached last year from office by the National Assembly. At the time, Adv Gcaleka was the acting Public Protector.
Gcaleka used the impeachment as her reason to deny Mkhwebane of the gratuity saying she was disqualified from benefiting.
Mkhwebane argued that what Gcaleka is doing is unlawful and unconstitutional.
While Mkhwebane wanted Gcaleka to be slapped with personal costs, the court ordered that the Public Protector South Africa be held responsible for the legal costs.
