81 years old man gets 19 years imprisonment for raping a minor in 2004

A rape victim who is now a young adult has finally gotten justice for an unfortunate incident that occurred 17 years ago where she was raped by an elderly man who at the time was on his 60s.

The now 81 years old man was sentenced to 15 years direct imprisonment by the Secunda Regional Court after being found guilty of rape and assaulting a minor in 2004.

It is said according to NPA Spokesperson Monica Nyuswa that at the time when the incident occurred in 2004, the victim who was six years old at the time, was attending nursery school in Balfour that was owned by the old man’s wife.

“On the day of the incident, the accused coerced the minor girl to accompany him into a bedroom and promised to give her a packet of peanuts. When she entered the room, he locked the victim inside, tied her up, undressed her clothes and raped her.”

But the matter was only reported nine years later because that victim was threatened with another rape at the time should she report or tell anyone about the incident.

“A forensic assessment report was also presented including the J88 report which proved that the victim was indeed sexually assaulted and the accused was found guilty as charged” said Nyuswa.

“During sentencing, the court found that there were compelling circumstances to deviate from the sentence of life, it took into consideration the accused’s age and sentenced him accordingly” added Nyuswa.

Thr convict was sentenced to four years imprisonment for indecent assault and fifteen years for rape. The court ordered the sentences in counts 1 and 2 to run concurrently.
