24 years man gets two life terms plus 15 years for murder including rape of a pregnant woman

The Ndarala family in the North West finally got justice for the brutal murder of their family member who were killed by the now convicted Pogiso Daniel Modiboa from Coligny.

The High Court in the North West division heard how the 24 years old from Tlhabologang went to the house of his first victim, Oupa Ndarala (68) at Tlhabologang location in Coligny and hit him with a knob-kierie on the forehead until he fell down before fleeing the scene with the old man’s bicycle and radio.

Along the way he then spotted Ndarala’s sister who was standing on a hiking spot on her way to town. He dragged her to the nearby bushes, raped her and hit her with a big rock on the head before fleeing the scene. She died on the scene from head injuries.

NPA Spokesperson in the area Henry Mamothame said that this incident occurred on June 25th, 2019.

He was on the run up until he was spotted in town later on and was subsequently arrested.

Much to the disappointment of the family, February 2020, the case was provisionally withdrawn from the court roll for further investigations.

“On 22 August 2020, Modiboa spotted a 19-year-old girl who was 8 months pregnant leaving a tavern in Tlhabologang location. He dragged her to his house and raped her twice. She managed to escape and reported the matter to the police, who later arrested him” said Mamothame.

Modiboa pleaded guilty to all charges on August 5th 2021 and was sentenced to two life terms plus 15 years in prison.

“He was sentenced to 15 years for robbery, life imprisonment for raping Ndarala’s sister, life imprisonment for murdering her and life imprisonment for the rape of a 19-year-old pregnant woman. The court also declared him unfit to posses a firearm.”

In aggravation of a maximum sentence, Advocate Benny Kalakgosi urged the court to have the accused to be recorded on the register of offenders who abuse older persons. He affirmed the absence of substantial and compelling circumstances which could convince the court to move away from the prescribed minimum sentence.
