“My suspension has expired, I’m going back to work”

While the suspended Public Protector Adv Busisiwe Mkhwebane awaits the decision from the National Assembly on whether they will adopt the recommendation by Section 194 enquiry or not, she said she intends to report back to work on Tuesday.
The parliamentary committee recommended that she be removed as the Public Protector following her suspension by President Ramaphosa.
Adv Mkhwebane took to social media to inform people that her suspension has expired as per the constitution and she will report back to work.
“On 9 June 2022 the President signed a Presidential Minute recording his decision to suspend the Public Protector, Adv Busisiwe Mkhwebane “pending the finalisation of the proceedings/inquiry initiated by the Committee of the National Assembly established in terms of section 194 of the Constitution.”
“According to the section 194 proceedings/inquiry has now been finalised.The period of suspension defined in the Presidential Minute issued in terms of section 194(3)(a),read with section 101(1)of the Constitution, has expired. Therefore and as a matter of courtesy and protocol Advocate Mkhwebane has advised President Ramaphosa that she will be reporting back to work tomorrow morning on Tuesday 5 September 2023” read the social media post.
Mkhwebane’s tenure expires next month and the Deputy Public Protector Adv Kholeka Gcaleka had been acting in her position since her suspension.
