25 years old man gets life plus 67 years for police murder

A 26 gang member has been sent to a little over 80 years in prison for the murder of a police officer. The matter has been on trial for the past 13 months since the incident occurred where the 26 years old Andile Nyoka found the 42 years old Sergeant Mario Angelique Nel in full uniform on May 3rd, 2023 at Motherwell Easter Cape and attacked him from behind.
They had a brawl until he put the officer on the ground, disarmed him and shot him on the head. Nyoka went on to hijack a Toyota Quantum taxi on Sisulu Street, NU29, Motherwell, at approximately 10:20 where he threatened the driver, demanding to be taken to Korsten, while holding two female passengers hostage who were in the taxi.
The taxi driver complied, driving down Sisulu Street until he spotted a police van. Fearing for his life, the driver jumped out while still in motion and ran to the police van for assistance.
The taxi collided with an electric pole. Nyoka then leaned out of the window and opened fire on the two police officers and the taxi driver. The officers returned fire, injuring Nyoka. Once subdued, authorities discovered the firearm used in the crime was in his possession, and he was then taken to Livingstone Hospital for medical treatment.
Reading out the victim impact statement from the wife of the deceased officer in the High Court of South Africa, Eastern Cape Division, Gqeberha, she said she had been attending the matter since it started because she wanted closure and accountability more than anything. She also said that Nyoka failed to show any remorse for his actions, not even an apology was offered to her and her family.
Advocate Dail Andrews pushed for a severe sentence, emphasizing the brutality of the crime and its profound impact on the community.
He argued that the murder of Sergeant Nel was not only heinous but also a direct attack on society, undermining trust in law enforcement and citizen safety. Andrews leveraged forensic and ballistic evidence, along with testimony from 22 state witnesses, to build a strong case against Nyoka, who pleaded not guilty to all charges.He was found guilty on 10 charges, including murder, kidnapping, attempted murder, and unlawful possession of a firearm and ammunition.
The court ordered that he serve at least 30 years of the life sentence, with the additional 67 years to be served consecutively. Notably, counts 9 to 11 will run concurrently, resulting in an effective sentence of 82 years imprisonment.
